About Social Security Disability Benefits

The Definition of Disability

According to the Social Security Administration's rules and regulations, disability is defined as the inability to engage in any substantial gainful activity by reason of any medically determinable physical or mental impairment which can be expected to result in death or which has lasted or can be expected to last for a continuous period of not less than 12 months.

Death of a family member

If someone passes away with an application for Social Security disability benefits pending at the Social Security Administration (SSA), a family member (substitution of party) may be able to continue the claim. You should always reach out to SSA when a family member passes away to see if there are any benefits available to the immediate family.

What about other programs?

Worker's compensation, Long-Term disability (LTD), and Veterans Administration (VA) benefits may directly offset a Social Security claim.
